You can make it work, but you must stay on the “lead-gen/marketing referral” side—don’t negotiate price/terms, don’t show property, don’t represent either party, and don’t call it a “commission” tied to a transaction unless the program is explicitly paying CPA/CPL for marketing services (many states treat transaction-based comp as brokerage activity). The safest setup I’ve used is: promote licensed operators (brokerages, REITs/funds, turnkey providers) via tracked links + disclosure/FTC + “not a broker/agent” disclaimers, get paid per qualified lead or per booked consult (fixed fee), and have the licensed partner handle all sales/contracting; if the offer pays % of deal value, have counsel check the state-by-state trigger rules and consider converting to a flat marketing fee via an affiliate IO.
